Welcome to Feel Form Studio! These Terms of Service ("Terms") govern your access to and use of our website and design subscription services. By subscribing to our services or using our website, you agree to these Terms.

1. Agreement to Terms

By accessing or using Feel Form Studio's services, you agree to:

• These Terms of Service
• Our Privacy Policy
• Any additional terms presented during subscription

If you do not agree, please do not use our services.

2. Service Description

2.1 What We Provide

Feel Form Studio offers design subscription services including:

• UI/UX design for web and mobile applications
• Brand identity and logo design
• Landing page and website design
• Social media graphics and marketing materials
• Presentation design and pitch decks
• Other graphic design services as agreed upon

2.2 What We Don't Provide

Our services do not include:

• 3D modeling or animation
• Video editing or production
• Copywriting or content writing
• Development or coding
• Printing or physical production
• Photography or videography

3. Subscription Plans

3.1 Available Plans

We offer monthly subscription plans:

• Growth Plan: $1,999/month - Two requests at a time
• Scale Plan: $3,499/month - Three requests at a time

3.2 Billing

• Subscriptions are billed monthly in advance
• First month may be offered at discounted rate
• Payment is due at the beginning of each billing cycle
• We accept credit cards and other payment methods via Stripe
• All fees are in USD unless otherwise stated

3.3 Auto-Renewal

Subscriptions automatically renew each month unless cancelled. You will be charged on the same date each month until you cancel.

4. Design Process

4.1 Request Submission

Clients submit design requests via:

• Trello board (provided upon subscription)
• Slack channel (for Scale plan)
• Email (hello@feelformstudio.com)

4.2 Request Queue

• Growth Plan: 2 requests active at a time
• Scale Plan: 3 requests active at a time
• Unlimited requests can be added to queue
• Requests processed in order received

4.3 Delivery Timeframes

• Growth Plan: 48-hour average delivery
• Scale Plan: 24-48 hour average delivery
• Complex projects may take longer (communicated upfront)
• Timeframes are estimates, not guarantees

4.4 Revisions

• Growth Plan: 5 revision rounds per request
• Scale Plan: Unlimited revisions per request
• Additional revisions on Growth: $149 per round
• Revisions must be requested within 14 days of delivery

5. Client Responsibilities

You agree to:

• Provide clear, detailed design briefs
• Supply necessary brand assets (logos, fonts, colors)
• Respond to questions within 48 hours
• Provide timely feedback on deliverables
• Maintain active payment method
• Use designs in accordance with these Terms

6. Intellectual Property

6.1 Ownership of Deliverables

You own 100% of the final designs. Upon full payment and final approval, all rights, title, and interest in the completed work transfer to you.

6.2 Work-in-Progress

We retain rights to work-in-progress until final delivery and payment. Incomplete or unpaid work remains our property.

6.3 Portfolio Rights

We reserve the right to:

• Display completed work in our portfolio
• Use as case studies (with your permission)
• Showcase on our website and social media

If you require confidentiality, notify us before starting the project.

6.4 Third-Party Assets

Stock photos, fonts, or third-party assets may require separate licensing. We'll inform you of any licensing requirements.

7. Cancellation and Refunds

7.1 Cancellation

You may cancel your subscription at any time:

• Cancellation takes effect at end of current billing period
• No refund for partial months
• Access to services continues until period ends
• No cancellation fees

7.2 Pause Subscription

You may pause your subscription:

• Pause for up to 2 months
• No charges during pause period
• Resume anytime without penalty

7.3 Refund Policy

7.4 Our Right to Cancel

We may cancel your subscription if you:

• Violate these Terms
• Fail to pay on time
• Abuse or harass our team
• Request illegal or unethical work

In such cases, no refund will be provided.

8. Payment Terms

8.1 Payment Methods

We accept major credit cards and debit cards via Stripe.

8.2 Failed Payments

• If payment fails, we'll notify you immediately
• You have 5 days to update payment method
• After 5 days, subscription may be suspended
• Work in progress will be paused

8.3 Price Changes

We may change prices with 30 days notice. Existing subscribers keep current price for 3 months after notice.

9. Acceptable Use

9.1 Prohibited Uses

You may not request designs for:

• Illegal activities or content
• Hate speech, discrimination, or violence
• Adult or explicit content
• Misleading or fraudulent purposes
• Infringement of third-party rights
• Spam or malicious content

9.2 Respectful Communication

We expect professional, respectful communication. Abusive, threatening, or harassing behavior will result in immediate termination without refund.

10. Warranties and Disclaimers

10.1 Our Commitment

We commit to:

• Deliver high-quality, original designs
• Meet agreed-upon timelines (reasonable delays communicated)
• Provide professional service
• Address concerns promptly

10.2 Disclaimers

Services are provided "as is" without warranty of any kind. We do not guarantee:

• Specific business results or conversions
• Uninterrupted or error-free service
• Designs will meet your subjective preferences
• Third-party approval (e.g., app store approval)

11. Limitation of Liability

To the maximum extent permitted by law:

• Our liability is limited to amount paid in past 3 months
• We are not liable for indirect, incidental, or consequential damages
• We are not liable for lost profits, data, or business opportunities
• You agree to indemnify us against claims arising from your use of our designs

12. Confidentiality

We agree to:

• Keep your business information confidential
• Not share your designs before launch (unless agreed)
• Sign NDA if required (at your request)
• Use information only for providing services

13. Force Majeure

We are not liable for delays caused by circumstances beyond our control, including:

• Natural disasters
• Internet outages
• Government actions
• Pandemics or health emergencies

14. Dispute Resolution

14.1 Informal Resolution

If you have a complaint, contact us first at hello@feelformstudio.com. We'll work to resolve it within 7 business days.

14.2 Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration rather than court litigation.

14.3 Governing Law

These Terms are governed by the laws of India. For international clients, we'll work within your local jurisdiction when reasonable.

15. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with updated "Last Updated" date. Material changes will be communicated via email 30 days in advance.

Continued use after changes constitutes acceptance.

16. Termination

Either party may terminate the service relationship:

• You: Cancel subscription anytime (effective end of billing period)
• Us: Terminate for violation of Terms (immediate, no refund)

Upon termination:

• Access to design portal ends
• Incomplete work will not be delivered
• You retain ownership of completed, paid work
• All outstanding payments become immediately due

17. Miscellaneous

17.1 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Feel Form Studio.

17.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

17.3 No Waiver

Failure to enforce any provision does not constitute a waiver of that provision.

17.4 Assignment

You may not transfer your subscription without our consent. We may assign our rights and obligations.
